DECLARATION OF BOATING ACTIVITY EXEMPTIONS

 

PUBLIC NOTICE DECLARATION OF BOATING ACTIVITY EXEMPTION Gannawarra Shire Council as the declared waterway manager for the waters of Kangaroo Lake, makes the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic). For the purposes of boating activity conducted by VJSBA trading as Jettin Vic, persons and vessels involved in the Winter Warrior PWC Endurance Race are exempt from the following requirements: State Rules made under the Marine Act 1988 1. Clause 2(a) – must not exceed 5 knots within 50 metres of a person in the water 2. Clause 2(c) – must not exceed 5 knots within 50 metres of another vessel 3. Clause 3(a) – must not exceed 5 knots within 50 metres of the water’s edge 4. Clause 3(b) – must not exceed 5 knots within 50 metres of a fixed or floating structure Waterway Rules made under the Marine Safety Act 2010 / Marine Act 1988 5. Clause 140.9 of Schedule 140 – area prohibited to vessels - east of Boat Ramp No.1 adjacent to Kangaroo Lake Caravan Park Marine Safety Regulations 2023 6. Regulation 61(5) – master requirement to carry specified equipment on personal watercraft (PWC) on inland waters (waterproof buoyant torch) Modification 7. For the purpose of boating activity conducted by Jettin Vic “Schedule 4, Table C - Lifejackets to be worn on certain recreational vessels on inland waters, Item 2 Personal watercraft”, of the Marine Safety Regulations 2023 (MSRs) is modified to include under Column 3 “Lifejacket requirements for inland waters — new standard”: If not meeting an applicable Australian Standard, a lifejacket that complies with the current Union Internationale Motonautique (UIM) Aquabike Rules 2024 rule 506.02, has been authorised by the O.O.D., Race Director or technical commissioner as adequate and safe (UIM Aquabike Rules 2024 rule 506.08), and must be intended for Personal Watercraft Closed Course Racing and Freeride and have a minimum buoyancy of 50N. Subject to the conditions detailed below: • Masters of rescue and official PWCs are only exempt from items 1 to 4 when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore, and item 5 for the duration of the event. • Persons on rescue and official PWCs must wear a lifejacket at all times when on the water during the event. • Masters of competing PWCs are only exempt from items 2 to 4 during designated warm-up, training and competition, and item 2 applies only when within 50 metres of another competitor or competing PWC. • Masters of competing PWCs are exempt from items 5 and 6 for the duration of the event. • Persons on competing PWCs must wear a lifejacket at all times when on the water that meets an applicable Australian Standard or the modification in item 7 and is maintained or serviced in a way that ensures that it is able to operate at all times in the way that it was designed to operate.
